Selecting a Title Agency is a personal choice. When you are making any major financial commitment, you should be confident that your title agent is prepared and experienced enough to handle any situation that may arise.
The simple truth is that as the Buyer you have the right to choose the Title Agency for the closing. You should find a company that has the expertise you need for your closing.
While Title Agency prices are determined by the State of New Jersey, not all title agencies are created equal. Make sure when calling for estimates that you receive a quote for ALL fees including premiums, search fees, settlement fees and recording fees. You do not want to be surprised by additional fees at your closing.
Sometimes, Real Estate Companies and/or Lenders have an Affiliated Business Arrangement (ABA) with a Title Agency they use or own. This means your Real Estate Company, Realtor and/or Lender may gain financially when you use their Title Agency. It is illegal to force or coerce an individual into using a specific Title Agency. If this happens you can file a report with The New Jersey Department of Banking and Insurance.
